Terms of Service

These Terms of Service ("Terms") govern your use of the Subsidly platform ("Service"), operated by Subsidly ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About the Service

Subsidly is an AI-powered platform that helps Australian businesses discover government grants and funding opportunities. The Service includes grant search, AI-powered matching, application assistance, and email notifications.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By registering, you represent that the information you provide is accurate and complete.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use at support@subsidly.com.au.

4. Subscription Plans & Payment

Subsidly offers Free, Pro (A$29/month), and AI Premium (A$79/month) plans. Paid subscriptions are billed monthly via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

  • Free plan: Grant search, basic matching, and profile creation at no cost.
  • Pro plan: AI-powered recommendations, email alerts, deadline reminders, and unlimited saved grants.
  • AI Premium plan: Everything in Pro, plus AI grant writing assistant, eligibility assessments, weekly digest, and high-value grant alerts.

Prices are in Australian dollars and exclude GST unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

5. Refund Policy

In accordance with the Australian Consumer Law, you have a 14-day cooling-off period from the date of your first paid subscription. If you are not satisfied, you may request a full refund within 14 days by contacting us at support@subsidly.com.au.

After the 14-day cooling-off period, subscriptions are non-refundable for the current billing period. You may cancel at any time, and your access will continue until the end of your current billing cycle. Cancellations can be made through the Stripe customer portal in your Settings page.

6. AI Disclaimer

The AI features provided by Subsidly are for informational purposes only and do not constitute professional, legal, financial, or tax advice.

  • AI-generated content (including eligibility assessments, draft application responses, and grant recommendations) is produced by automated systems and may contain errors or inaccuracies.
  • We do not guarantee that using the Service will result in a successful grant application or the receipt of any funding.
  • You are solely responsible for verifying all AI-generated content before submitting it in any grant application.
  • Grant eligibility criteria, funding amounts, and deadlines are sourced from government websites and may change without notice. Always verify details directly with the relevant government agency.
  • Subsidly is not affiliated with, endorsed by, or in any way officially connected to any Australian government department or agency.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorised access to other users' accounts or our systems.
  • Scrape, crawl, or use automated tools to access the Service except through our official API (if applicable).
  • Transmit malicious code, spam, or any content that infringes third-party rights.
  • Misrepresent your identity or business information to obtain inaccurate grant recommendations.

8. Intellectual Property

All content, software, designs, and trademarks on the Service are owned by Subsidly or its licensors. You may not reproduce, modify, or distribute any part of the Service without our prior written consent. Content you generate using our AI tools remains your own, but we retain the right to use anonymised and aggregated data to improve the Service.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Subsidly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

10. Indemnification

You agree to indemnify and hold harmless Subsidly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms or your use of the Service.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time from the Settings page. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
